BAND COMMAND’s “SCREEN YOUR SCENE” OFFICIAL CONTEST RULES

THE FOLLOWING CONTEST IS INTENDED TO HELP COLLECT VENUE INFORMATION TO MAKE BOOKING AND TOURING INFORMATION FREELY AVAILABLE TO EVERY ARTIST AND BAND, BECAUSE HAVING TO PAY FOR INFORMATION AND WASTING TIME LOOKING FOR VENUES TO PLAY AT SUCKS.

THIS CONTEST IS FOR BANDS AND ARTISTS IN THE UNITED STATES ONLY. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE OFFICIAL CONTEST RULES.

Entry

Entrants enter the contest by fully completing and submitting the signup form online at www.bandcommand.com/venue_add.php. Each venue fully submitted will count as an entry into the contest, with unlimited entries available for each band to submit. Only one artist or band is allowed per /email address.

Eligibility

This contest is open only to legal residents of the United States residing in the continental United States and Hawaii. Entrants must be 16 years or older as of September 1, 2004. Don’t ask us why, it’s just the age rule they say we have to follow to give away prizes.

Contest Period and Drawings

The “Screen Your Scene” contest begins September 1, 2004 and will end on September 30, 2004. Entries for all prizes must be received by 11:59PM, CST, September 30, 2004. Potential prize winners will be notified by email, telephone and/or overnight courier within thirty (30) days after the applicable drawing. Band Command will post the winning band or artist on the Band Command website. If a winner is unreachable for five (30) days after being contacted by Band Command, or if that winner is otherwise unavailable for prize fulfillment, we will make fun of you and/or sling insults on our site and might give your prize to someone else, so you had better get on it. All winners will be subject to verification and must meet all eligibility requirements before a prize is awarded. Basically, be at least 16 years old, ok?

Odds of winning depends upon the total number of eligible entries. Translation: The more venues you enter for the contest, the better your odds over other bands that only enter 1 or 2. Get it? Enter more you enter, the better your chances of winning. ALL PRIZES ARE AWARDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLIDNG, WITHOUT LIMITATION, ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR WARRANTY OF MERCHANTABILITY.

General Considerations

Prizes will be awarded to winners directly from prize sponsor. Winners are responsible for the payment of all applicable federal, state and local taxes.

Limitation of Liability

Neither Band Command nor any of its affiliates is responsible for printing or typographical errors in any contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, or illegible entries; or for transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction. Band Command reserves the right to cancel or modify the contest if fraud or technical failures compromise the integrity of the contest, as determined by Band Command in its sole discretion. By entering, participants release and hold harmless Band Command, Real Headway, LLC and its affiliates and their respective directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for, or participating in any prize-related activity. So if you try entering in a venue while putting a fork into a toaster or something, you’re on your own.

Use of Information

Except where prohibited by law, entry constitutes permission to Band Command and its affiliates to use each winners name, city and state of residence, likenesses, and any statements made by winner regarding the contest and the prizes, for publicity purposes (including, without limitation, use on the web site of Band Command and/or its affiliates) without any compensation and for purposes of complying with all applicable federal, state and local laws and regulations. In other words, we may want to let people know that you are awesome and you won all sorts of cool stuff.

Intellectual Property

This contest and all accompanying materials are Copyright 2004 Band Command. If you entered a venue, it becomes our responsibility to keep that information updated so other bands can get accurate, up to date information. You may, however ask us to change the information yourself, which would help everyone keep it up to date and make you very cool in our book. Copying or unauthorized use of any copyrighted materials, trademarks or other intellectual property without the express written consent of Real Headway LLC and Band Command is strictly prohibited.
